CHP Responds To Hundreds Of Weather-Related Accidents
SAN DIEGO -- The rain has made for a tough day on San Diego's freeways. 10News digital correspondent Kyle Majors covered an especially busy day for local public safety officials. The accidents came fast and often. Traffic backed up on eastbound 94 near Massachusetts when the driver of a GMC Envoy slid from the roadway. And slick roads were tough no matter what your tax bracket. A Maserati crashed into the center barrier on southbound 163 at Balboa. Traffic backed up for miles and the hits kept coming: a Ford F-150 on 163 at the 8; a Honda at north 805 at University. California Highway Patrol's traffic incident Web site usually has a handful of incidents on a normal day. Today the list stretched for pages. Most accidents in the morning consisted of minor injuries but the afternoon turned deadly. A passenger in a Glen Oakes rollover was killed when the roof collapsed. The driver and passenger were transported to Sharp Memorial Hospital with moderate injuries. Ten miles under the posted speed limit proved too fast for rain-soaked streets. Interestingly, the wreck occurred at almost the exact location of a similar accident early Tuesday morning, although roads were dry at the time. CHP officer Brian Pennings reminds motorists to slow down and always wear a seatbeat. "When there is wet roadways your stopping distance is greatly increased so you need to greatly increase your following distance and lower your speed so you can percieve and react to anything that presents itself," Pennings said. The rain has been solid all day long, as a result California Highway Patrol has responded to hundreds of traffic accidents. With no sign of the rains letting up, it looks to be a dangerous commute home.

Rainfall brings 90 traffic incidents to county roads during morning commute
NORTH COUNTY ---- Steady rain clogged traffic across North County this morning, causing dozens of accidents, flooding some intersections and slowing traffic to a crawl on many major roads. Freeway conditions appear to be improving as the morning commute winds down. The California Highway Patrol's Web site reported 52 incidents between 9 .am. and 10 a.m., but only 38 incidents between 10 a.m and 11 a.m. Though none of the incidents in that two-hour period were classified as "major injuries," many CHP entries said injury information was not yet available. At 10:45 a.m., North County Fire Communications, which dispatches departments in Rancho Santa Fe, Encinitas, Vista, San Marcos and Solana Beach, reported that paramedics had not been called to any major incidents. The CHP did report flooding this morning on Interstate 15 at Carmel Valley Road and at the Interstate 805 intersection. Oceanside appeared to be getting the heaviest rain, according to the National Weather Service. The city had received more than half an inch by 8 a.m. today, according to the Weather Service's Web site. Ramona had received 0.19 inch, and San Diego had received o.14 inch at Lindbergh Field. Rainfall totals for other areas were not available. Rain is expected to continue through today, according to the Weather Service. Clearing is expected Saturday, with sunny skies returning early next week. The rainfall is the first significant precipitation in many months and brings at least temporary relief from one of the worst fire seasons in years.

Rain causes spike in accidents, shutdown on I-805
SAN DIEGO ---- California Highway Patrol reported at least 187 car accidents on San Diego County roads by 1 p.m. today due to slick conditions on rain-soaked roads. On a typical day, just 50-75 accidents occur, an official said. In addition, accidents and debris on roads have caused numerous road closures and delays, with more expected as the night goes on, the official said. As of 2:30 p.m., all lanes of northbound I-805 near Highway 54 in southern San Diego are closed until further notice due to an accident involving a semi-trailer.

Woman in critical condition after driving off freeway
LOS ANGELES—Authorities say a 28-year-old woman is in critical condition after driving off the San Diego (405) Freeway, across an on ramp and onto a west Los Angeles street. The California Highway Patrol said the crash on the northbound freeway, north of Pico Boulevard, was called in at 12:03 a.m today. The CHP said the driver, a woman from Newhall, was driving a 2004 Lexus northbound at an unknown speed when she allowed the car to travel off the freeway, down a dirt embankment and across the onramp to the northbound 405 from Cotner Avenue. CHP said the motorist was ejected after the car then overturned and hit two parked vehicles along the west curb edge of Cotner Avenue. Authorities said she was transported to UCLA Medical Center, and there were no other persons involved.

Shortly after 1 a.m., Sunday, the Athens Police Department received a call that a woman had been hit by a vehicle on Texas Highway 31 West. APD officers Jason McIntire and Roger Keith were the first to the scene followed by Athens Fire Department rescue personnel. “The victim was dead at the scene,” Assistant Police Chief Rodney Williams. “The deceased was a black female in her late 30’s.” Police were withholding the name of the woman until a positive identification was made and relatives notified. Although there were clues pointing to the woman’s identity at the scene, Williams said authorities were not certain who the deceased was. “We are awaiting the medical examiner for confirmation,” Williams said the examiner. was looking at the victims dental records. He expected to receive that information by Wednesday. The Athens Review will report any developments in the investigation as they become available.

$1.3M Awarded To Injured In Accident
SNOW HILL – A Bel Air, Md. woman was awarded nearly $1.3 million in damages this week, bringing closure to a complex lawsuit dating back to the summer of 2004 involving serious injuries sustained during an accident at an Ocean City amusement park. Lindsey McCormack, now 20, of Bel Air, and her parents sued just about everybody involved in the accident at Speed World inside the Jolly Roger amusement park in Ocean City following an go-kart accident that fractured her spine and caused other serious injuries from which she is still recovering. Named in the suit was the parent company Bayshore Development Inc., Jolly Roger Rides, Inc., several employees at the park at the time and R.E, Enterprises Inc., the California-based company that manufactured and sold the go-karts. After a lengthy discovery period on both sides, the case against Bayshore Development, Jolly Roger and the employees were dismissed, while the suit focused on R.E. Enterprises, the manufacturer and supplier of the go-kart. In Worcester County Circuit Court on Monday, Judge Thomas C. Groton ruled R.E. Reynolds was negligent in the design of the go-karts and ordered the defendant to play nearly $1.3 million in damages to McCormack...

Most reckless drivers in America?
Over the past five years, I have nearly been run over twice in parking lots when drivers, without looking in their rearview mirrors, accelerated while their cars were in reverse gear. A child standing in the same spot would have been run over. I have had to take evasive action on numerous occasions to avoid cars running red lights or stop signs. I have driven past several intersection accidents, including one traffic fatality...

Zachary, who was a junior at Steele Canyon Charter High School, wasn't speeding or driving under the influence of drugs or alcohol. Investigators said he overcorrected his Ford Explorer after it veered off the road near Jamul, causing it to flip over and strike a utility pole...

Auto insurers let parents track teens
When 17-year-old Anna Kinderman takes a turn too fast in her parents' sedan or jams the brakes too hard, she apologizes aloud even when no one else is in the car. "Sorry, Dad," she says, looking up at the camera mounted on the rearview mirror. Mom and Dad will see the incident on video soon enough, after all. Several U.S. auto insurers have begun offering in-car cameras or global positioning equipment to help parents monitor their teenagers' driving behavior, hoping to reduce the alarming number of crashes involving young new motorists. Industry experts say it's too soon to gauge the effectiveness of programs like American Family Insurance Co.'s Teen Safe Driver, used by the Kindermans in Madison, Wis. But the case for needing to improve highway safety for teens is compelling. Traffic accidents are by far the No. 1 killer of U.S. teenagers, with a fatality rate four times higher than drivers aged 25 to 69. A total of 5,288 teens died in traffic accidents in 2005, and more than 7,000 were driving cars involved in fatal accidents. Insurance companies can benefit significantly if the initiatives catch on, according to Craig Weber, senior insurance analyst with research and consulting firm Celent. "It's a unique opportunity for them to help change behavior, which will help them drive down rates, which will make customers happy," Weber said. Even if rates don't drop, he added, "it's a huge win in building customer loyalty and generating positive PR." ...

SAN DIEGO, 12:07 p.m. Oct. 12: Two people were rescued Friday from a car that plowed into the back of a nearly empty school bus and burst into flames on a Bay Terraces-area freeway offramp, according to the California Highway Patrol. The accident occurred shortly before 7:30 a.m. as the driver of the sedan exited eastbound State Route 54 at Briarwood Road, according to the CHP. The bus driver, who was alone in the school vehicle, was unhurt, the CHP reported. He and others, including an off-duty firefighter, pulled two occupants out of the car before it was engulfed in flames. Medics took the victims to a hospital for treatment of apparently non-life-threatening injuries, possibly including broken bones, the Highway Patrol reported. The crash, which left the car wedged almost halfway underneath the bus, caused heavier-than-usual morning commute congestion in the area.

Bus Collision
A vehicle became wedged under a school bus today when the two vehicles collided on the Briarwood offramp of eastbound State Route 54 in the Fairmont Park area of San Diego, authorities said. The accident, which occurred at 7:39 a.m., caused no injuries, said California Highway Patrol officer Rob Sanchez. The bus was empty except for the driver, and the driver in the smaller vehicle was able to come out safely before it caught fire, Sanchez said. The accident left SR 54 traffic backed up.

Crash injuries take man's life
The official cause of death for Willis "Ish" Hatch will be linked to an auto accident. But if friends and relatives could pen the death certificate, they might enter just two words: "Broken heart." "I think we all feel that way," said Sandie VanWeelven, a close friend to the Hatches. Hatch, 92, died Tuesday evening, three days after pulling his vehicle into the path of another car in an accident that claimed the life of his wife, Arlene, 93. A front-page column in Tuesday's Press quoted Willis Hatch mourning the loss of a woman with whom he fell asleep every night for 57 years after gazing at their special star. The accident injured the driver of the other car as well -- Katherine Tissue, 26, of Sydney, in Montcalm County, who suffered a broken foot. Her son, Cody, 4, escaped unhurt. Hatch was admitted to Spectrum Health Butterworth Campus on Saturday with fractures to his pelvis and other complications. Relatives say he went into cardiac arrest around 6 p.m. Monday and died about 24 hours later. "It's really tragic, but you know, it's for the best," VanWeelven said of his passing. Of his wife's death and his role in the accident, he "just couldn't be consoled," she said. "We feel, completely, that this was a broken heart." The couple lived most of their lives together on an 1800s-era farm near Alto. She taught in the Lowell schools for 33 years while he tended to cattle on what once was 300 acres...

Man dies in auto accident
A Fairbanks man died following an early morning vehicle accident Tuesday at the intersection of Mitchell Expressway and University Avenue. The Pontiac was totaled. Damages to the pickup truck were estimated at about $5,000. The cause of the accident is still under investigation, but Alaska State Troopers said there was some ice on the roadway. Alcohol does not appear to have been a factor.

Students escape injury in North bus crash
A busload of middle school students escaped injury this morning in an auto accident on Commonwealth Avenue, snarling commuter-hour traffic for about 45 minutes. The 68-year-old driver of a car that collided with the bus at Robinson Avenue was taken to Sturdy Memorial Hospital complaining of pain, according to police. As a precaution, the 43 students on the bus were examined by local firefighters but none reported being injured, police said. They were taken to school on another bus after being examined, Detective Lt. David Dawes said. The cause of the 7:30 a.m. accident remains under investigation. The accident occurred as the bus was turning left from Robinson Avenue west onto Commonwealth Avenue. The car was heading east on Commonwealth Avenue, Dawes said. The car, which sustained scratches and dents on its front end and hood, was towed from the scene. The bus sustained minor damage and was later driven away. Have you been injured in an auto accident? Are you confused and don't know what to do, where to go, or who to talk to? Do you need medical treatment? These are important questions. Being involved in an accident creates a lot of stress and is an emotional time filled with personal frustration.

  • First check to see if anyone has suffered injuries and call 911 if emergency treatment help is needed.
  • Get the other driver's information, including insurance policy information, auto and contact info.
  • Take pictures of the accident scene and damage to the vehicles and bodily injuries if there are any.

ACCIDENTS AND INJURIES

Including auto, auto/pedestrian, auto/bicycle, slip-and-fall injuries.
If you have been in an auto accident caused by the reckless driving of another, you should first check to see if you or a passenger has been injured. If yes, consider calling 911 to get emergency medical treatment at the accident scene. You should also get informationa about the other driver. For example, his or her name, address, driver license number, insurance information. If there are police at the scene, get the officer's name and badge number. You should also write down a brief description of how the accident occured in case you later can't remember all the details. Take pictures of the damage to the vehicles and to your injuries on your cell phone and/or later for evidence. After receiving any/all needed medical treatment, you should call both your automobile insurance and the other driver's auto insurance compay to report the accident. However, when calling, stick to the facts of the accident and how it occured. It is a good idea to not discuss your injuries other than "I'm hurt and need treatment" because one, you are not a doctor, and two, pain and injuries many times do not appear until a few days afte the accident.

MEDICAL TREATMENT FOR INJURIES

If you have been injured in an auto accident, you should get the medical treatment you need. You may have been taken to the emergency room by ambulance and now need follow up treatment. You should get the medical treatment you need whether or not you have insurance.

Don't have insurance? Many of us do not have medical insurance to cover the expense of doctors. If you fall into this category, you will probably find yourself having to pay for the medical treatment up front. The isurance company might reimburse you for the medical treatment later on down the line but you will need to pay first - there are many varying factors and it all depends on your case and the facts.

If you don't have health insurance, we can still help you obtain immediate medical treatment for you, and you don't have to pay back the doctors until you receive the money from your settlement. If you find yourself in the above situation, please call us.

We know doctors who will treat many cases on a lien basis. This means that the doctor will not charge you until your case settles. Don't pass up medical treatment you need simply because you can't afford medical treatment and the insurance company will not pay them for you. Call us now. PROPERTY DAMAGE

The damage to your vehicle, referred to as property damage, is often an important issue in car accident cases. The insurance company should have your automobile repaired or have it replaced for its value if it is totaled. If your vehicle is undriveable, you may also be entitled to car rental reimbursement. Insurance companies are not in business to pay you money. The insurance carriers often dispute the extent of your property damage claim. As part of my service to you, I will fight the insurance carriers to resolve your property damage claim.

SAN DIEGO AUTO ACCIDENT ATTORNEY

If you've been in an auto accident or otherwise injured by the fault of another in San Diego county or elsewhere, you are not alone. Personal Injury cases arising out of automobile accidents are by far the most common type of personal injury case pending in our court system today. An attorney to help get you the best possible monetary settlement for your personal injury.

I fight with insurance companies to get my clients all they are entitled to under the law. Many cases, if not most, will settle prior to filing a lawsuit and preparing for trial. This saves you, the client, and the insurance company money. Trial costs can be expensive - expert fees, deposition costs, and other court expenses. There is also the added benefit of getting your monetary compensation a lot sooner than you would be if the case goes to trial. Automobile insurance companies know this and for that reason they offer settlement outside of court to avoid trial expenses.
